Terms of Service

Terms and conditions for using our services

1. Acceptance of Terms

By accessing and using the services provided by Dazzlepond Institute ("we," "us," or "our"), you ("participant," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or participate in our programs.

2. Description of Services

Dazzlepond Institute provides outdoor education and camping programs across Canada, including:

  • Weekend camping basics courses
  • Advanced wilderness skills training
  • Wilderness first aid certification
  • Family camping adventures
  • Custom outdoor education programs
  • Online resources and educational content

3. Eligibility and Registration

Age Requirements

  • Participants must be 18 years or older to register independently
  • Minors (under 18) must have parental or guardian consent
  • Family programs welcome children 6 years and older with adult supervision

Health and Fitness

Participants must:

  • Be in sufficient physical condition for the chosen program
  • Disclose any medical conditions, allergies, or medications
  • Provide emergency contact information
  • Follow all safety instructions provided by our guides

Registration Process

  • Complete registration forms accurately and honestly
  • Pay all fees as outlined in the program pricing
  • Acknowledge assumption of risk and liability waivers
  • Attend mandatory pre-program orientations when required

4. Fees and Payment

Program Fees

  • All fees are listed in Canadian dollars (CAD)
  • Fees include instruction, equipment, meals, and accommodation as specified
  • Additional costs (transportation, personal gear) are participant's responsibility
  • Prices are subject to change without notice for future programs

Payment Terms

  • Payment is due at time of registration unless payment plan is arranged
  • We accept major credit cards and e-transfers
  • Outstanding balances may result in program cancellation
  • All payments are processed securely through third-party payment processors

5. Cancellation and Refund Policy

Participant Cancellations

  • 14+ days before program: Full refund minus $50 processing fee
  • 7-13 days before program: 50% refund
  • Less than 7 days: No refund (medical emergencies considered case-by-case)
  • No-shows: No refund

Dazzlepond Institute Cancellations

We reserve the right to cancel programs due to:

  • Insufficient enrollment (minimum 4 participants)
  • Severe weather or unsafe conditions
  • Instructor illness or emergency
  • Government restrictions or park closures

In case of our cancellation, participants receive full refund or credit toward future programs.

6. Assumption of Risk and Liability

Inherent Risks

Outdoor activities involve inherent risks including but not limited to:

  • Falls, injuries, and physical strain
  • Wildlife encounters
  • Weather-related hazards
  • Equipment failure
  • Remote location challenges

Assumption of Risk

By participating in our programs, you acknowledge and assume all risks associated with outdoor activities. You participate voluntarily and at your own risk.

Release of Liability

To the fullest extent permitted by law, you release Dazzlepond Institute, its owners, employees, contractors, and affiliates from any claims, damages, or liability arising from your participation in our programs.

7. Participant Responsibilities

Safety Compliance

  • Follow all safety instructions and guidelines
  • Use provided safety equipment properly
  • Report unsafe conditions immediately
  • Stay with designated groups unless authorized otherwise

Respectful Behavior

  • Treat guides, staff, and other participants with respect
  • Follow Leave No Trace principles
  • Respect wildlife and natural environments
  • Comply with all applicable laws and regulations

Personal Property

  • Participants are responsible for their personal belongings
  • Dazzlepond Institute is not liable for lost, stolen, or damaged personal items
  • We recommend travel insurance for valuable items

8. Code of Conduct

We maintain a zero-tolerance policy for:

  • Harassment, discrimination, or bullying
  • Alcohol or drug use during programs
  • Reckless or dangerous behavior
  • Damage to equipment or environment
  • Failure to follow guide instructions

Violations may result in immediate program dismissal without refund.

9. Photography and Media

By participating in our programs, you consent to:

  • Photography and video recording during activities
  • Use of your likeness in marketing materials
  • Sharing testimonials and feedback (with permission)

If you prefer not to be photographed, please inform your guide at the beginning of the program.

10. Intellectual Property

All content, materials, and curriculum provided by Dazzlepond Institute are protected by copyright and other intellectual property laws. Participants may not:

  • Reproduce or distribute our educational materials
  • Use our content for commercial purposes
  • Teach or instruct using our proprietary methods without permission

11. Weather and Environmental Conditions

  • Programs operate in various weather conditions as part of the learning experience
  • Extreme weather may modify or postpone activities for safety
  • No refunds for weather-related program modifications
  • Participants must come prepared for all weather conditions

12. Equipment and Gear

Provided Equipment

  • Major camping equipment is provided as specified
  • Participants are responsible for any damage beyond normal wear
  • Lost or stolen equipment will be charged to participant

Personal Gear

  • Participants must bring items specified in packing lists
  • Failure to bring required gear may affect program participation
  • We may provide emergency gear loans at our discretion

13. Privacy and Data Protection

Your personal information is collected and used in accordance with our Privacy Policy. By using our services, you consent to our data collection and use practices as outlined in the Privacy Policy.

14. Modifications to Services

Dazzlepond Institute reserves the right to:

  • Modify program content, locations, or schedules
  • Substitute qualified instructors when necessary
  • Update safety protocols and procedures
  • Change equipment specifications

Significant changes will be communicated to registered participants in advance.

15. Limitation of Liability

To the maximum extent permitted by law, Dazzlepond Institute's liability is limited to the fees paid for the specific program. We are not liable for:

  • Indirect, consequential, or punitive damages
  • Lost profits or business opportunities
  • Travel expenses or accommodation costs
  • Medical expenses (participants should have appropriate insurance)

16. Governing Law

These Terms of Service are governed by the laws of Alberta, Canada. Any disputes will be resolved in the courts of Alberta.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Changes to Terms

We may update these Terms of Service periodically. Continued use of our services after changes constitutes acceptance of the new terms.
